About these terms

These terms and conditions apply to your use of our website, theorangebird.co.uk, and to anything you buy from us online, including products from our shop, gift vouchers and Orange Bird Club memberships. They also cover table bookings made through our website.

By using our website or placing an order, you agree to these terms. Please read them carefully, along with our Privacy Policy and Refund Policy. If you have any questions, get in touch before ordering.

Who we are

Using our website

You may use our website for your own personal, non-commercial use. You must not misuse it, including by attempting to gain unauthorised access, introducing viruses or harmful code, or using it in any way that is unlawful or that could damage the website or our business.

We work hard to keep our website accurate and up to date, but we cannot guarantee it will always be available or free from errors. We may update, suspend or change any part of it at any time.

Our products

We make every effort to describe and photograph our products accurately. As many of our products are handmade in small batches, colour, texture and appearance may vary slightly from the images shown.

Please read each product's description, ingredients and allergen information carefully before ordering. Our products are made in a kitchen that handles a wide range of ingredients, including common allergens, so we cannot guarantee that any product is completely free from traces of allergens. If you have any questions about allergens, please contact us before placing your order.

Always follow the storage and use instructions on the label, and use products by the date shown.

Prices and payment

All prices are shown in pounds sterling. Delivery charges are shown separately at checkout before you pay.

We may change our prices at any time, but changes will not affect orders already confirmed. While we take care to make sure prices are correct, if we discover an error in the price of something you have ordered, we will contact you before processing your order to let you choose whether to continue at the correct price or cancel.

Payment is taken in full at the time of ordering through our secure payment providers.

Placing an order

When you place an order, you will receive an email acknowledging it. This does not mean your order has been accepted. Your order is accepted, and a contract between us is formed, when we confirm it has been dispatched or, for digital products and memberships, when access is provided.

We may decline or cancel an order, for example if a product is out of stock, if we cannot deliver to your address or if there is an error in the price or description. If this happens, we will let you know and refund any payment in full.

Delivery

Delivery options, charges and estimated delivery times are shown at checkout. Delivery times are estimates and may be affected by events outside our control, such as courier delays or bad weather.

Please make sure your delivery address is correct and that someone is available to receive perishable items. Once your order has been delivered to the address you gave us, it becomes your responsibility.

Returns and refunds

Because most of our products are food, we cannot accept returns unless items arrive damaged, faulty or incorrect. Full details are set out in our Refund Policy, which forms part of these terms.

Gift vouchers

Gift vouchers can be used at the restaurant as shown on the voucher and must be used within the validity period stated. Vouchers cannot be exchanged for cash, and we cannot replace vouchers that are lost, stolen or used by someone else. Any unused balance cannot be refunded, except where the law requires it.

Orange Bird Club

Orange Bird Club membership costs £90 a year and gives access to the member benefits described on our website. Benefits are personal to the member and cannot be transferred or shared. We may change, add to or replace individual benefits from time to time, and will always aim to offer benefits of a similar value.

Membership renews each year unless cancelled. You can cancel within 14 days of joining for a full refund as long as you have not used any member benefits, and you can cancel at any time to stop your membership renewing. Full details are in our Refund Policy.

We may end a membership if a member breaches these terms or behaves in a way that is abusive or disruptive to our team or guests.

Table bookings

Bookings made through our website are subject to availability and to the booking terms shown when you book. In particular:

- please give us at least 24 hours' notice if you need to cancel
- we hold tables for 15 minutes after the booking time, so please let us know if you are running late
- tables are booked for a set length of time, depending on the size of your party, which will be shown when you book

Please tell us about any allergies or dietary requirements when you book, and remind your server when you arrive.

Intellectual property

All content on our website, including text, photographs, logos, designs and recipes, belongs to the Orange Bird or is used with permission. You may not copy, reproduce, share or use any of it for commercial purposes without our written permission. Recipes you buy from us are for your own personal use only.

Our liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law. Your statutory rights as a consumer are not affected.

We are not responsible for any loss or damage that was not foreseeable, that was caused by events outside our reasonable control, or that results from products not being stored or used in line with their instructions. Our total liability to you for any order will not exceed the amount you paid for it.

Your privacy

We look after your personal information in line with our Privacy Policy.

Changes to these terms

We may update these terms from time to time. The version on our website when you place an order is the one that applies to that order.

Law and jurisdiction

These terms are governed by the law of England and Wales, and any disputes will be dealt with by the courts of England and Wales.
